Terms & Conditions
The following terms and conditions apply to all transactions with Fairmont and Main Limited. Please read them carefully and print a copy for your records. All prices are in £ sterling.
We reserve the right to change any advertised price before you place an order. All products are subject to availability and may be withdrawn at any time. If your order cannot be fulfilled, you will be offered an alternative.
DELIVERY CHARGED
Orders within the UK mainland (excluding Highland, Grampian, & Tayside) amounting to less than £350
will be subject to an £8.50 freight charge.
Orders to Offshore locations (including Ireland, Highland, Grampian, & Tayside) amounting to less
than £500 will be subject to a £20.00 freight charge.
All overseas orders will be sold on an F.O.B. (Free On Board) basis or by negotiation.
Goods will be delivered to you at the address you supply at
the time of ordering. The goods will be delivered as soon as possible,
but we cannot guarantee delivery within any particular time.
PAYMENT
Our standard payment terms are 30 days from date of invoice. New customers are required to pay on a Pro-forma basis.
DAMAGED AND DEFECTIVE GOODS
If the goods delivered to you are not as ordered (i.e. Incorrect item or quantity), or are damaged or defective on
receipt, please notify us in writing (including email and fax) within three
working days of the delivery of the goods, otherwise we cannot accept liability.
All items must be returned to us for a credit to be raised.
STATUTORY RIGHTS PRESERVED
Nothing in these terms and conditions:
- affects any of your statutory rights that may not be excluded or limited, or
- excludes or limits our liability to you for any death or personal injury resulting from our negligence.
FORCE MAJEURE
We will have no liability to you for any failure or delay in complying with any of our obligations under these terms and conditions that is caused by any event or circumstance outside our reasonable control.
GENERAL
These terms and conditions are governed by, and will be construed in accordance with, English law. By confirming your order you consent to these terms and conditions and to the exclusive jurisdiction of the English courts in all disputes arising out of the sale of goods. If any provision of these terms and conditions is deemed invalid or unenforceable for any reason, that provision will be severed from these terms and conditions and the remaining provisions will continue to apply.
